2 ENROLLED, An Act,
3 Relating to reduced speed school zones; to amend
4 Sections 32-5A-181, 32-5A-182, and 32-5A-183, Code of Alabama
5 1975, to provide that the reduced speed school zone applies to
6 every public and private school in the state; and in
7 connection therewith would have as its purpose or effect the
8 requirement of a new or increased expenditure of local funds
9 within the meaning of Amendment 621 of the Constitution of
10 Alabama of 1901, now appearing as Section 111.05 of the
11 Official Recompilation of the Constitution of Alabama of 1901,
12 as amended.
13 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
14 Section 1. Sections 32-5A-181, 32-5A-182, and
15 32-5A-183, Code of Alabama 1975, are amended to read as
16 follows:
17 "32-5A-181.
18 "For the purposes of this article, the following
19 words have the following meanings:
20 "(1) REDUCED SPEED SCHOOL ZONE. A designated length
21 of a road or highway extending between school zone speed limit
22 signs with or without warning lights.
23 "(2) ROAD or HIGHWAY. Any road or highway except an
24 interstate highway.

1 "(3) SCHOOL ZONE. All public or private school
2 property, including school grounds and any road or highway
3 abutting the school grounds and extending 300 feet along the
4 road or highway from the school grounds.
5 "32-5A-182.
6 "A reduced speed school zone is established for any
7 every public or private school in the county outside the
8 corporate limits of a municipality state, including schools
9 along state-maintained roads or highways.
10 "(1) At an appropriate distance before reaching a
11 reduced speed school zone, an appropriate sign or signs shall
12 be erected warning of the approaching reduced speed school
13 zone.
14 "(2) A sign or signs at the end of the school zone
15 shall designate where the motor vehicle may resume the regular
16 speed limits.
17 "(3) All signs and signing locations shall be in
18 accordance with the rules contained in the current Manual of
19 Uniform Traffic Control Devices.
20 "32-5A-183.
21 "(a) Signs on a reduced speed school zone located on
22 a county-maintained road shall be placed and maintained by the
23 county commission.

1 "(b) Signs on a reduced speed school zone located on
2 a municipality-maintained road shall be placed and maintained
3 by the municipality.
4 "(b) (c) Signs on a reduced speed school zone
5 located on a state-maintained road or highway within a county
6 shall be placed and maintained by the State Department of
7 Transportation."
8 Section 2. Although this bill would have as its
9 purpose or effect the requirement of a new or increased
10 expenditure of local funds, the bill is excluded from further
11 requirements and application under Amendment 621, now
12 appearing as Section 111.05 of the Official Recompilation of
13 the Constitution of Alabama of 1901, as amended, because the
14 bill defines a new crime or amends the definition of an
15 existing crime.
16 Section 3. This act shall become effective on the
17 first day of the third month following its passage and
18 approval by the Governor, or its otherwise becoming law.
