2 ENROLLED, An Act,
3 Relating to St. Clair County; to amend Section 1 Act
4 2015-93 of the 2015 Regular Session (Acts 2015, p. 306),
5 providing for court costs for defendants charged with a
6 criminal act in St. Clair County.
7 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
8 Section 1. Section 1 of Act 2015-93 of the 2015
9 Regular Session is amended to read as follows:
10 "(a) In St. Clair County, a booking fee court cost
11 in the amount of thirty dollars ($30) shall be assessed by the
12 clerk of the court as court costs against each any defendant
13 who incarcerated in or booked in any county jail in St. Clair
14 County if the defendant is convicted, or pleads guilty , or
15 against any defendant whom costs are otherwise assessed in
16 cases prosecuted in the circuit court, or district court, or
17 any municipal court of the county.
18 "(b) The clerk of the court shall enter the booking
19 fee court costs on the docket sheet and collect the fee in the
20 same manner and at the same time as other court costs are
21 collected. The booking fee court costs assessed pursuant to
22 this act shall be in addition to all other fines, court costs,
23 or other charges now or hereafter provided by law. The court
24 costs provided by this act shall not be waived by any court

1 unless all other fees, assessments, costs, fines, and charges
2 associated with the case are waived.
3 "(c) The clerk of the court shall remit the booking
4 fees court costs collected pursuant to this act on a monthly
5 basis to the St. Clair County Commission to be deposited in
6 the county general fund to be used for the construction of a
7 new county jail or jails and the subsequent maintenance and
8 operation thereof." the county general fund to be used for the
9 construction of a new county jail or jails and the subsequent
10 maintenance and operation thereof. as follows:
11 "(1) If the proceeds collected under this section
12 are less than five hundred thousand dollars ($500,000)
13 annually, all of the proceeds shall be used for the
14 construction of a new county jail or jails or the subsequent
15 maintenance and operation thereof.
16 "(2) If the proceeds collected under this section
17 are at least five hundred thousand dollars ($500,000), but
18 less than six hundred thousand dollars ($600,000) annually, 10
19 percent of the proceeds shall be used for the renovation,
20 reconstruction, and maintenance of the justice facilities in
21 the City of Ashville, with the remainder of the proceeds used
22 for the construction of a new county jail or jails or the
23 subsequent maintenance and operation thereof.
24 "(3) If the proceeds collected under this section
25 are at least six hundred thousand dollars ($600,000), but less

1 than seven hundred thousand dollars ($700,000) annually, 12.5
2 percent of the proceeds shall be used for the renovation,
3 reconstruction, and maintenance of the justice facilities in
4 the City of Ashville, with the remainder of the proceeds used
5 for the construction of a new county jail or jails or the
6 subsequent maintenance and operation thereof.
7 "(4) If the proceeds collected under this section
8 are at least seven hundred thousand dollars ($700,000), but
9 less than eight hundred thousand dollars ($800,000) annually,
10 15 percent of the proceeds shall be used for the renovation,
11 reconstruction, and maintenance of the justice facilities in
12 the City of Ashville, with the remainder of the proceeds used
13 for the construction of a new county jail or jails or the
14 subsequent maintenance and operation thereof.
15 "(5) If the proceeds collected under this section
16 are at least eight hundred thousand dollars ($800,000), but
17 less than nine hundred thousand dollars ($900,000) annually,
18 17.5 percent of the proceeds shall be used for the renovation,
19 reconstruction, and maintenance of the justice facilities in
20 the City of Ashville, with the remainder of the proceeds used
21 for the construction of a new county jail or jails or the
22 subsequent maintenance and operation thereof.
23 "(6) If the proceeds collected under this section
24 are at least nine hundred thousand dollars ($900,000), but
25 less than one million dollars ($1,000,000) annually, 20

1 percent of the proceeds shall be used for the renovation,
2 reconstruction, and maintenance of the justice facilities in
3 the City of Ashville, with the remainder of the proceeds used
4 for the construction of a new county jail or jails or the
5 subsequent maintenance and operation thereof.
6 "(7) If the proceeds collected under this section
7 are one million dollars ($1,000,000) or more annually, 25
8 percent of the proceeds shall be used for the renovation,
9 reconstruction, and maintenance of the justice facilities in
10 the City of Ashville, with the remainder of the proceeds used
11 for the construction of a new county jail or jails or the
12 subsequent maintenance and operation thereof."
13 Section 2. This act shall become effective
14 immediately following its passage and approval by the
15 Governor, or its otherwise becoming law.
