8 Relating to the State Board of Health and the
9 immunization registry; to amend Section 22-11B-2, Code of
10 Alabama 1975, to require health care providers to report
11 immunization data to the registry and to review the registry
12 before a vaccine is administered with certain exceptions.
13 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
14 Section 1. Section 22-11B-2, Code of Alabama 1975,
15 is amended to read as follows:
16 "22-11B-2.
17 "Pursuant (a) Pursuant to and in furtherance of the
18 purposes of this chapter, the State Board of Health is
19 authorized to may create and maintain an immunization
20 registry. The immunization registry is the central collection
21 of data and reports concerning a vaccine dose or doses
22 administered to a person by a provider records on vaccines
23 administered to all ages, including historical records of
24 vaccinations. The nature of the immunization information
25 contained in this registry shall be determined by rule of the
26 State Board of Health and shall be obtained from clinic
27 records, billing data and information, and vital or any other

1 records owned and controlled by the State Board of Health and
2 the Alabama Medicaid Agency. Medical insurers and public and
3 private providers are authorized and encouraged to provide
4 information to the registry. In the absence of a
5 bi-directional interface with the registry to send current or
6 retrieve historical records of vaccination administrations,
7 all providers shall review the registry before a vaccine is
8 administered and provide all vaccine data through electronic
9 interface or manual entry in the registry. If the provider is
10 using a bi-directional electronic interface, the provider
11 shall review the historical vaccination information provided
12 through that interface before a vaccine is administered, and
13 the information for any vaccine the provider administers shall
14 be entered into the registry either through the interface or
15 by manual entry into the registry. Annual influenza
16 vaccinations shall be reported to the registry, but a review
17 of the registry is not required prior to the administration of
18 an influenza vaccine. registry. Notwithstanding any other
19 provisions of this chapter, annual influenza vaccinations are
20 exempt from this section if adults are age 19 and over."
21 "(b) Providers shall enter vaccine information into
22 the registry created under subsection (a). The State Board of
23 Health shall disclose vaccine information in accordance with
24 state law and the Health Insurance Portability and
25 Accountability Act.

1 "(c) Nothing in this section shall be construed to
2 require the tracking or disclosure of personal identifying
3 information of individuals who have not received vaccinations.
4 Section 2. This act shall become effective
5 immediately following its passage and approval by the
6 Governor, or its otherwise becoming law.
