2 ENROLLED, An Act,
3 Relating to voter fraud; to amend Sections 17-13-24
4 and 17-17-36, Code of Alabama 1975, to prohibit a voter in
5 this state from also voting in another state; to provide
6 further for criminal penalties; and in connection therewith
7 would have as its purpose or effect the requirement of a new
8 or increased expenditure of local funds within the meaning of
9 Amendment 621 of the Constitution of Alabama of 1901, as
10 amended by Amendment 890, now appearing as Section 111.05 of
11 the Official Recompilation of the Constitution of Alabama of
12 1901, as amended.
13 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
14 Section 1. Sections 17-13-24 and 17-17-36, Code of
15 Alabama 1975, are amended to read as follows:
16 "17-13-24.
17 "Any voter in this state who shall vote votes more
18 than once, or attempt attempts to vote more than once, in any
19 primary election held in this state, or who votes in both this
20 state and another state or territory in the same or equivalent
21 election, shall, on conviction, be punished in the same manner
22 as provided for voting or attempting to vote more than once in
23 a general election as provided in Section 17-17-36.

1 "Any person who votes more than once at any election
2 held in this state, or deposits more than one ballot for the
3 same office as his or her vote at such election, or knowingly
4 attempts to vote when not entitled to do so, or is guilty of
5 any kind of illegal or fraudulent voting, shall be guilty,
6 upon conviction, of a Class C felony.
7 "(a) It shall be unlawful for an individual to vote
8 in this state more than once at any election held in this
9 state, or to vote in both this state and another state or
10 territory in the same or equivalent election, or to attempt to
11 vote when he or she has knowledge that he or she is not
12 entitled to vote, or to commit any kind of unlawful or
13 fraudulent voting.
14 "(b)(1) Except as provided in subdivsion (2), a
15 violation of this section is a Class A misdemeanor.
16 "(2) A second or subsequent violation of this
17 section is a Class C felony."
18 Section 2. Although this bill would have as its
19 purpose or effect the requirement of a new or increased
20 expenditure of local funds, the bill is excluded from further
21 requirements and application under Amendment 621, as amended
22 by Amendment 890, now appearing as Section 111.05 of the
23 Official Recompilation of the Constitution of Alabama of 1901,
24 as amended, because the bill defines a new crime or amends the
25 definition of an existing crime.

1 Section 3. This act shall become effective
2 immediately following its passage and approval by the
3 Governor, or its otherwise becoming law.
