2 ENROLLED, An Act,
3 Relating to Baldwin County; to provide for the
4 assessment and collection of additional court costs in certain
5 criminal cases in circuit and district courts for the
6 creation, implementation, and continued administration of a
7 mental health diversionary program; and to provide for the
8 distribution of proceeds.
9 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
10 Section 1. (a) In Baldwin County, in addition to any
11 court costs and fees now or hereafter authorized in the
12 county, additional court costs in the amount of ten dollars
13 ($10) shall be assessed and collected as costs on each civil
14 case and on each criminal case, including traffic cases and
15 small claims cases filed in the circuit court and district
16 court, including the juvenile court and except those filed in
17 the juvenile or family court.
18 (b) (1) The costs shall be collected as other costs
19 in cases are assessed and collected by the clerk of the court
20 and shall be paid by the clerk to the Baldwin County
21 Commission. The county commission, in consultation with the
22 judge assigned to the mental health diversionary program,
23 shall distribute the proceeds of the court costs to the
24 circuit court and the district attorney for the creation,
25 implementation, and continuing administration of a mental

1 health diversionary program, to be known as the "mental health
2 court."
3 (2) The fees shall not be waived by any court unless
4 all other fees, assessments, costs, fines, and charges
5 associated with the case are waived.
6 Section 2. This act shall become effective on the
7 first day of the third month following its passage and
8 approval by the Governor, or its otherwise becoming law.
