4 ENROLLED, An Act,
5 To amend Section 16-54-2, Code of Alabama 1975,
6 relating to the Board of Trustees of the University of
7 Montevallo; to allow one of the trustees serving on the board
8 to be a nonresident appointed at-large.
9 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
10 Section 1. Section 16-54-2 of the Code of Alabama
11 1975, is amended to read as follows:
12 "16-54-2.
13 "The University of Montevallo shall be governed by a
14 board of trustees composed of the Governor, who shall be
15 president, ex officio, the State Superintendent of Education,
16 ex officio, and 11 other trustees (one from each congressional
17 district, up to one at-large trustee who is not a resident of
18 this state, and, until as otherwise herein provided, a number
19 of trustees from the state-at-large sufficient to bring the
20 number to or keep it at 11.) Five members of the board shall
21 constitute a quorum. Trustees shall be appointed for a term of
22 12 years. In case of the creation and establishment of an
23 additional congressional district in the state, the at-large
24 state-at-large trustee most recently appointed shall cease
25 automatically cease to be a trustee from the state-at-large

1 and become for the remainder of the term trustee for such the
2 new district. Otherwise, all new appointees, except for a
3 nonresident appointee and the state-at-large appointees, shall
4 be at the time of their appointment, residents of the district
5 for which they are appointed, respectively. All appointments
6 of trustees shall be made by the Governor with the advice and
7 consent of the Senate. In case of a vacancy in the office of
8 trustee, the Governor shall appoint a successor, who shall
9 hold office till until the next meeting of the Legislature,
10 when the Governor, by and with the advice and consent of the
11 Senate, shall appoint a trustee, who shall hold office for the
12 unexpired term. A trustee shall be ineligible to be elected by
13 the board of trustees to or otherwise hold any office of the
14 institution where compensation is provided. The trustees are
15 entitled to receive payment of their actual expenses incurred
16 in the discharge of their duties as such trustees."
17 Section 2. This act shall become effective on the
18 first day of the third month following its passage and
19 approval by the Governor, or its otherwise becoming law.
