8 SYNOPSIS: Under existing law, the Alabama Board of
9 Social Work Examiners is responsible for the
10 licensing and regulation of social workers in the
11 state.
12 This bill would authorize the board to
13 charge and collect fees for verifying the existence
14 of a current license, reactivating an inactive
15 license, reinstating a lapsed license, making
16 application to act as a continuing education
17 provider, and registering a supervisor.
18 This bill would also make technical
19 corrections to reflect changes in license names.

23 AN ACT

25 To amend Section 34-30-57, Code of Alabama 1975,
26 relating to the duties of the Alabama Board of Social Work
27 Examiners; to authorize the board to charge and collect fees

1 for verifying the existence of a current license, reactivating
2 an inactive license, reinstating a lapsed license, making
3 application to act as a continuing education provider, and
4 registering a supervisor; and to make technical corrections to
5 reflect changes in license names.
6 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7 Section 1. Section 34-30-57 of the Code of Alabama
8 1975, is amended to read as follows:
9 "34-30-57.
10 "In addition to the duties set forth elsewhere in
11 this chapter, the Board of Social Work Examiners shall do all
12 of the following:
13 "(1) Recommend modifications and amendments to this
14 chapter.
15 "(2) Recommend to the appropriate district attorneys
16 prosecutions for the violations of this chapter, after and
17 only after the alleged violator has been notified of such
18 violation or violations and having been given 90 days to
19 disclaim, amend, and rectify such allegation.
20 "(3) Annually publish a list of the names and
21 addresses of all persons who are:
22 "a. "Licensed bachelor social workers," "licensed
23 graduate master social workers," and "licensed certified
24 independent clinical social workers" under this chapter.
25 "b. Eligible to engage in the private independent
26 practice of social work under this chapter.

1 "(4) Establish fees for initial examination,
2 licensure, certification, and renewal thereof; fees for
3 verifying the existence of a current license, reactivating an
4 inactive license, and reinstating a lapsed license; fees for
5 making application to the board to act as a continuing
6 education provider; and fees for registering a supervisor.
7 "(5) Establish requirements and standards for
8 continuing education. In establishing such requirements, the
9 board shall consult with those groups and organizations which
10 represent both the levels of practice specified in this
11 chapter and the various settings in which social work is
12 practiced. Furthermore, in developing such requirements, the
13 board shall consider, but shall not be limited in its
14 consideration to, agency recognized staff development programs
15 under the auspices of public agencies, continuing education
16 programs offered by colleges and universities having social
17 work programs approved or accredited by the Council on Social
18 Work Education, and continuing education programs offered by
19 recognized state and national social work bodies.
20 "(6) Promulgate Adopt rules and regulations pursuant
21 to the State Alabama Administrative Procedures Statute
22 Procedure Act that set forth professional standards for
23 "licensed bachelor social workers," "licensed graduate master
24 social workers," and "licensed certified independent clinical
25 social workers" who are certified for the private independent
26 practice of social work. Those proposed rules and regulations
27 shall be published at least 30 days prior to before the public

1 hearing relative to the proposed rules and regulations, and at
2 least 15 days in advance of such before the hearing, the board
3 shall publish notice of the date, time, and place where such
4 the public hearings of the board will shall be held for the
5 purpose of adopting or amending rules and regulations
6 pertaining to this chapter."
7 Section 2. This act shall become effective
8 immediately following its passage and approval by the
9 Governor, or its otherwise becoming law.
