2 ENROLLED, An Act,
3 Relating to education; to amend Section 16-64-6,
4 Code of Alabama 1975, relating to public institution tuition
5 practices, to require annual reports of tuition practices be
6 posted on the website of the Alabama Commission on Higher
7 Education; and to amend Section 36-21-102, Code of Alabama
8 1975, relating to the administration of the Police Officer's
9 and Firefighter's Survivors Educational Assistance Program, to
10 include any dependant natural child of a law enforcement
11 officer, firefighter, or rescue squad member born after the
12 death of, or any dependent child born or adopted after the
13 total disability of, the law enforcement officer, firefighter,
14 or rescue squad member.
15 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
16 Section 1. Sections 16-64-6 and 36-21-102, Code of
17 Alabama 1975, are amended to read as follows:
18 "16-64-6.
19 The out-of-state tuition practices of each
20 institution, and particularly decisions regarding resident and
21 nonresident status and reporting thereof, shall be audited
22 collected annually by the Alabama Commission on Higher
23 Education or by the Examiners of Public Accounts. An annual
24 report of institutional tuition policies shall be posted on
25 the Alabama Commission on Higher Education's website.

1 "36-21-102.
2 "When a full-time law enforcement officer or
3 full-time firefighter employed by the state, by any county, or
4 by any municipality, a volunteer firefighter, or a rescue
5 squad member is or was killed or becomes totally disabled in
6 the line of duty, free tuition for undergraduate study at any
7 state college, state community college, state junior college,
8 state technical college, in the State of Alabama, and other
9 costs officially prescribed for the classes in the course of
10 study, shall be paid for the following:
11 "(1) Any dependent child, natural or adopted, under
12 21 years of age at the time of death or total disability, or
13 any dependent natural child under the age of 21 born after the
14 death of the law enforcement officer, firefighter, or rescue
15 squad member, or any dependant child, natural or adopted,
16 under 21 years of age who is born or adopted after the total
17 disability of the law enforcement officer, firefighter, or
18 rescue squad member.
19 a. Notwithstanding subdivision (1), to receive
20 benefits under this section an adopted dependent shall have
21 been adopted, and resided in the household of the law
22 enforcement officer, firefighter, or rescue squad member, for
23 at least five years prior to enrollment in undergraduate
24 study.

1 "(2) A spouse who has not remarried, provided
2 initial enrollment is within five years of the death or total
3 disability of the law enforcement officer, firefighter,
4 volunteer firefighter, or rescue squad member."
5 Section 2. This act shall become effective on the
6 first day of the third month following its passage and
7 approval by the Governor, or its otherwise becoming law.
