8 SYNOPSIS: Under existing law, agricultural liming
9 material sold in this state is required to be
10 labeled with certain specified information
11 including the minimum calcium carbonate equivalent.
12 The label is not required to contain information on
13 the relative neutralizing value of the liming
14 material.
15 This bill would define relative neutralizing
16 value as a value based on the calculation of the
17 calcium carbonate equivalent in relation to percent
18 of lime passing through mesh screens and would
19 require agricultural lime to be labeled with the
20 relative neutralizing value of the lime.

26 Relating to agricultural liming material; to amend
27 Sections 2-23-2 and 2-23-4 of the Code of Alabama 1975,

1 relating to the labeling of agricultural liming material sold
2 or imported into this state; to define relative neutralizing
3 value and to require agricultured liming material to be
4 labeled with the relative neutralizing value.
5 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
6 Section 1. Sections 2-23-2 and 2-23-4 of the Code of
7 Alabama 1975, are amended to read as follows:
8 "2-23-2.
9 "The following terms, as used in this chapter and
10 rules and regulations promulgated adopted under authority of
11 this chapter, shall have the following meanings, respectively:
12 "(1) AGRICULTURAL LIMING MATERIALS. Those products
13 whose calcium and magnesium compounds are capable of
14 neutralizing soil acidity
15 "(18) (2) BOARD. The Board of Agriculture and
16 Industries of the State of Alabama.
17 "(10) (3) BRAND. The term, designation, trademark,
18 product name or the specific designation under which an
19 individual or type of agricultural liming material as defined
20 in this section is offered for sale.
21 "(15) (4) BULK. Nonpackaged form.
22 "(5) BURNT LIME. A material made from limestone
23 which consists essentially of calcium oxide or a combination
24 of calcium and magnesium oxides.
25 "(3) (6) CALCITIC LIMESTONE. A calcareous rock
26 composed wholly or largely of calcium carbonate.

1 "(12) (7) CALCIUM CARBONATE EQUIVALENT or CCE. The
2 acid neutralizing capacity of an agricultural liming material
3 expressed as weight percentage of calcium carbonate.
4 "(7) (8) CHALK. A soft, friable, loosely
5 consolidated material composed largely of calcium carbonate.
6 "(17) (9) COMMISSIONER. The Commissioner of
7 Agriculture and Industries of the State of Alabama.
8 "(4) (10) DOLOMITIC LIMESTONE. A calcareous rock
9 composed of calcium and magnesium carbonates with a minimum
10 elemental magnesium (Mg) content of six percent.
11 "(11) FINENESS. The percentage by weight of the
12 material which will pass U.S. standard sieves of specified
13 sizes.
14 "(8) (12) GROUND SHELLS. A product obtained by the
15 grinding of shells of mollusks and which shall carry the name
16 of mollusk origin.
17 "(6) (13) HYDRATED LIME. A material made from burnt
18 lime which consists essentially of calcium hydroxide or a
19 combination of calcium hydroxide with magnesium oxide and/or
20 magnesium hydroxide.
21 "(9) (14) INDUSTRIAL BY-PRODUCT USED AS LIMING
22 MATERIALS. Any industrial by-product containing calcium or
23 calcium and magnesium in forms that will neutralize acidity.
24 "(16) (15) LABEL. Any written or printed matter on
25 or attached to the package or delivery ticket which
26 accompanies a bulk shipment.

1 "(2) (16) LIMESTONE. A calcareous rock composed
2 primarily of calcium carbonate or a combination of calcium and
3 magnesium carbonates.
4 "(14) (17) PERCENT or PERCENTAGE. By weight.
5 "(19) (18) PERSON. Any individual, partnership,
6 corporation, association or other legal entity, or
7 organization.
8 "(19) RELATIVE NEUTRALIZING VALUE or RNV. A
9 calculation that uses calcium carbonate equivalent and
10 fineness to represent the effectiveness of agricultural liming
11 materials.
12 "(13) (20) TON. Two thousand pounds avoirdupois.
13 "2-23-4.
14 "(a) Agricultural liming materials sold or offered
15 for sale in this state for use herein or sold for importation
16 into this state for use herein shall have affixed to each
17 container in a conspicuous manner on the outside thereof a
18 clearly legible printed or stamped label, tag, or statement
19 or, in the case of bulk sales, a delivery slip, setting forth
20 at least all of the following information:
21 "(1) The name and principal office of the
22 manufacturer, processor or distributor;.
23 "(2) The brand name of the material;.
24 "(3) The identification of the product as to the
25 type of agricultural liming material, as defined in
26 subdivisions (2) through (9) of Section 2-23-2;.

1 "(4) The minimum percent guaranteed by weight
2 passing through U. S. standard sieves as prescribed by
3 regulations of the board;.
4 "(5) The minimum guaranteed calcium carbonate
5 equivalent;.
6 "(6) The minimum guaranteed content of elemental
7 magnesium (Mg) if claimed;.
8 "(7) The minimum guaranteed content of available
9 potassium (K2O) and/or or phosphorus (P2O5), or both, if
10 claimed;.
11 "(8) The maximum water content; and.
12 "(9) Net weight.
13 "(10) The relative neutralizing value (RNV) as
14 determined by the following formula:
15 "RNV = CCE x (.5A + B), where A is the percent of
16 lime passing through a 10-mesh screen, but not a 60-mesh
17 screen, and B is the percent of lime passing through a 60-mesh
18 screen.
19 "(b) No information or statement shall appear on any
20 package label, delivery slip, or advertising matter which is
21 false or misleading to the purchaser as to the quality,
22 analysis, type, or composition of any agricultural liming
23 material."
24 Section 2. This act shall become effective on the
25 first day of the third month following its passage and
26 approval by the Governor, or its otherwise becoming law.
