8 SYNOPSIS: This bill would require a food service
9 establishment using a drive-through window to post
10 any earned food establishment inspection report
11 score below the grade of 85 in a conspicuous place
12 on its drive-through menu signs and to promptly
13 update the score number on each drive-through menu
14 sign upon the receipt of any new food establishment
15 inspection report scores, unless the establishment
16 earns a score of 85 or higher.

22 Relating to public health; to require a food service
23 establishment using a drive-through window to post any earned
24 food establishment inspection report score below the grade of
25 85 in a conspicuous place on its drive-through menu signs
26 under certain conditions.
27 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

1 Section 1. (a) For purposes of this section, the
2 following terms have the following meanings:
3 (1) DEPARTMENT. The Alabama Department of Public
4 Health.
5 (2) FOOD SERVICE ESTABLISHMENT. A place, vehicle, or
6 vessel, regulated by the Alabama Department of Public Health
7 and subject to its permitting requirements, at which food for
8 individual portion service is prepared, stored, held,
9 transported, served, or dispensed.
10 (b) A food service establishment using a
11 drive-through window shall post, in a conspicuous place on any
12 drive-through menu signs used by the establishment, any food
13 establishment inspection report score below the grade of 85
14 awarded to the establishment by the department and shall
15 promptly update the score number on each drive-through menu
16 sign upon the receipt of any new food establishment inspection
17 report scores from the department, unless the establishment
18 earns a score of 85 or higher.
19 (c) The department shall adopt rules for the
20 implementation of this section.
21 Section 2. This act shall become effective on the
22 first day of the third month following its passage and
23 approval by the Governor, or its otherwise becoming law.
