8 SYNOPSIS: Under existing law, a public official or
9 public employee who holds more than one public
10 office, position, or employment may only receive
11 the salary of the highest paid office, position, or
12 employment.
13 This bill would require an occupational
14 licensing board, agency, or commission to notify a
15 newly appointed board member of this restriction.
16 This bill would also require all members of
17 an occupational licensing board, agency, or
18 commission to sign a statement each year as to
19 their eligibility to receive a salary or
20 compensation for serving on the board, agency, or
21 commission.

1 Relating to occupational licensing boards, agencies,
2 and commissions; to add Section 41-9A-3 to the Code of Alabama
3 1975; to require occupational licensing boards, agencies, and
4 commissions to notify newly appointed board members of the
5 limitation on receiving only the salary of the highest paid
6 position if the board member holds more than one public
7 position; and to require each board member to annually certify
8 eligibility to receive a salary or compensation, if
9 applicable, for serving on the board, agency, or commission.
10 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
11 Section 1. Section 41-9A-3, is added to the Code of
12 Alabama 1975, to read as follows:
13 41-9A-3.
14 (a) An occupational licensing board shall notify
15 each newly appointed board member of the restriction on
16 receiving more than one salary or compensation from the state
17 under Section 36-6-3.
18 (b) An occupational licensing board that provides a
19 salary or compensation to its board members for serving on the
20 board, on an annual basis, shall require each member of the
21 board to sign a statement stating that the board member is
22 eligible to receive the salary or compensation under Section
23 36-6-3.
24 Section 2. This act shall become effective on the
25 first day of the third month following its passage and
26 approval by the Governor, or its otherwise becoming law.
