4 ENROLLED, An Act,
5 Proposing an amendment to the Constitution of
6 Alabama of 1901, relating to Walker County, to provide that
7 the elected or appointed Walker County officials, including
8 the Sheriff of Walker County may participate in the Employees'
9 Retirement System in lieu of participating in a supernumerary
10 program or system.
11 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
12 Section 1. The following amendment to the
13 Constitution of Alabama of 1901, is proposed and shall become
14 valid as a part of the Constitution when all requirements of
15 this act are fulfilled:
16 PROPOSED AMENDMENT
17 (a) No elected or appointed Walker County official,
18 including the sheriff, may assume a supernumerary office after
19 the effective date of this amendment. Any person who, on the
20 effective date of this amendment, is participating in a
21 supernumerary program as a supernumerary sheriff shall not
22 continue to participate in that supernumerary program, and may
23 purchase service credit in the Employees' Retirement System
24 for the time the official served in office. Any person who, on
25 the effective date of this amendment, is participating in a

1 supernumerary program other than serving as a supernumerary
2 sheriff may continue to participate in that supernumerary
3 program, which shall include the assumption of a supernumerary
4 office according to the terms and conditions of the law which
5 established that supernumerary program. Every elected or
6 appointed Walker County official, including the sheriff, may
7 participate in the Employees' Retirement System of Alabama
8 upon the same terms and conditions as may be specified by law
9 for any other employee in the same retirement system. Walker
10 County officials holding office at the time of ratification of
11 this amendment shall be eligible to purchase service credit in
12 the Employees' Retirement System for the time the official has
13 served in the current office; provided, however, the official
14 shall forego the assumption of a supernumerary office.
15 (b) For purposes of this amendment, "elected or
16 appointed Walker County official" does not include a judge,
17 district attorney, legislator, constable, school board member,
18 or any official elected from a judicial circuit.
19 Section 2. An election upon the proposed amendment
20 shall be held in accordance with Amendment 555 to the
21 Constitution of Alabama of 1901, now appearing as Section
22 284.01 of the Official Recompilation of the Constitution of
23 Alabama of 1901, as amended, and the election laws of this
24 state.

1 Section 3. The appropriate election official shall
2 assign a ballot number for the proposed constitutional
3 amendment on the election ballot and shall set forth the
4 following description of the substance or subject matter of
5 the proposed constitutional amendment:
6 "Relating to Walker County, proposing an amendment
7 to the Constitution of Alabama of 1901, to provide that
8 elected and appointed officials in Walker County may
9 participate in the Employees' Retirement System in lieu of
10 participating in a supernumerary program or system.
11 "Proposed by Act _________."
12 This description shall be followed by the following
13 language:
14 "Yes ( ) No ( )."
