2 ENROLLED, An Act,
3 Relating to Houston County; to provide for a
4 transaction fee on certain tag transactions in the county; to
5 provide for distribution of the proceeds for emergency medical
6 services; and to provide a referendum.
7 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
8 Section 1. (a) In Houston County, the Houston County
9 Judge of Probate shall collect a tag transaction fee in the
10 amount of five dollars ($5) for each motor vehicle tag,
11 excluding utility trailers, issued or renewed in the county.
12 The fee shall not apply to tag transfers and replacement
13 transactions. The tag transaction fee shall be in addition to
14 any other fees authorized by law.
15 (b)(1) Three percent of the proceeds from the fees
16 collected pursuant to subsection (a) shall be retained by the
17 judge of probate to be used for the operation of his or her
18 office.
19 (2) Except as provided in subsection (d), the
20 remainder of the proceeds from the fees collected pursuant to
21 subsection (a) shall be distributed to the Houston County
22 Commission to be further distributed to the Houston County EMS
23 Association for further distribution to EMS transport
24 providers and the Dothan Fire Department, EMS Division.

1 (c) The proceeds distributed by the county
2 commission pursuant to subdivision (b)(2) shall be used solely
3 to provide emergency medical services in the county including
4 salaries, equipment, supplies, matching funds, training, or
5 other purposes directly related to the providing of emergency
6 medical services. The proceeds may not be used for
7 construction or maintenance of facilities.
8 (d) Notwithstanding subsection (b), the county
9 commission, by resolution adopted upon a majority vote, may
10 use a portion of the funds to contract with private emergency
11 medical services if the county determines that contracts with
12 private emergency medical services are necessary.
13 Section 2. Section 1 of this act shall become
14 operative only if approved by a majority of the qualified
15 electors of Houston County who vote in an election to the held
16 on the day designated by the Judge of Probate of Houston
17 County. The notice of the election shall be given by the judge
18 of probate, and the election shall be held, conducted, and the
19 results canvassed in the manner as other county elections. The
20 election shall be held in conjunction with the 2020 general
21 election. The question shall be "Do you favor the adoption of
22 Act ______, of the _____ Session of the Alabama
23 Legislature? YES_____ NO ______." The county shall pay any
24 costs and expenses not otherwise reimbursed by a governmental
25 agency which are incidental to the election. If a majority

1 votes cast in the election are "Yes," Section 1 of this act
2 shall become operative January 1 following approval. If the
3 majority of the votes are "No," this act shall be repealed and
4 shall have no further effect. The judge of probate shall
5 certify the results of the election to the Secretary of State.
6 Section 3. This act shall become effective on the
7 first day of the third month following its passage and
8 approval by the Governor, or its otherwise becoming law.
