2 ENROLLED, An Act,
3 Relating to the City of Decatur; to amend Sections
4 3, 4, and 7 of Act 95-363 of the 1995 Regular Session (Acts
5 1995, p. 732), to further provide for the terms of office of
6 the Decatur City Board of Education; and to provide for the
7 compensation of the members of the board.
8 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
9 Section 1. Sections 3, 4, and 7 of Act 95-363 of the
10 1995 Regular Session (Acts 1995, p. 732) are hereby amended to
11 read as follows:
12 "Section 3. A candidate for each place on the board
13 of education shall be at least 21 years of age, a resident of
14 the school board district which he or she seeks to represent
15 on the board for at least 90 consecutive days prior to the
16 deadline date for qualifying as a candidate, and shall not
17 have a record of conviction for any crime involving moral
18 turpitude. At the time of qualifying, each candidate for each
19 place on the board shall pay a qualifying fee in an amount
20 prescribed by the city council not later than six months prior
21 to the qualifying deadline as provided by law. The
22 qualification fee for the first elections to be held for the
23 board created by this act, however, shall be twenty-five
24 dollars ($25) for each candidate. The dates for qualifying
25 shall be the same as for mayor-council candidates.

1 "Section 4. Elected school board members shall serve
2 four-year terms with the elections and terms thereof
3 coinciding with those of the members of the city council of
4 Decatur. The elections for board members shall be held at the
5 regular election for city council of Decatur after the
6 effective date of this act. The elected board members shall
7 serve from the date on which they are sworn into office until
8 the swearing in of their successors following the next
9 regularly scheduled city council and school board elections.
10 Terms of office for the elected board members shall commence
11 on the first Monday of October at the same time as the terms
12 of office of members of the city council following their
13 election. Any vacancies that may occur on the board, from time
14 to time, shall be filled by appointment by the remaining
15 members of the board in the same manner as provided by law for
16 filling vacancies on the city council. The chairmanship of the
17 board shall be selected by vote of the board as a whole at the
18 board's annual meeting.
19 "Section 7. The compensation for the members of the
20 school board shall be three hundred dollars ($300) per month
21 to be paid from the city school system funds, unless changed
22 pursuant to this section. The board may change this the amount
23 of compensation by majority vote thereof, which changes must
24 but any vote to establish or change compensation shall be made
25 not later than six months be held at least one month prior to

1 the deadline for qualification of candidates for seats on the
2 board and shall not take effect until the next term of office
3 of the members of the board. Members of the board shall be
4 reimbursed for documented expenses associated with activities
5 outside of the City of Decatur in the performance of their
6 duties as board members. Thereafter, the compensation as set
7 by the board, from time to time, shall be in effect for
8 successor boards."
9 Section 2. This act shall become effective
10 immediately following its passage and approval by the
11 Governor, or its otherwise becoming law.
