2 ENROLLED, An Act,
3 Relating to Montgomery County; to provide for the
4 qualifications of the sheriff; and to require completion of
5 continuing education.
6 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7 Section 1. This act shall only apply in Montgomery
8 County.
9 Section 2. (a) On or after the effective date of
10 this act, a person qualifying for election to the office of
11 sheriff in the county or any person appointed to serve as a
12 sheriff shall meet all of the following minimum
13 qualifications, in addition to any other qualifications
14 required by law:
15 (1) The person is a citizen of the United States.
16 (2) The person has been a resident of the county for
17 at least one year immediately prior to the qualification date.
18 (3) The person has the qualifications of an elector
19 pursuant to state and federal law and the person has been
20 registered to vote in the county at least one year immediately
21 prior to qualifying.
22 (4) The person has been awarded a four-year college
23 degree from an accredited university.
24 (5) The person is 25 years of age or older prior to
25 qualifying.

1 (6) The person at the time of qualifying has three
2 or more years of immediate prior service as a law enforcement
3 officer having the power of arrest.
4 (7) The person has never been convicted of a felony.
5 (b) Upon election, the sheriff of the county shall
6 attend annually a minimum of 12 hours of continuing education
7 approved by the Alabama Sheriffs Association.
8 Section 3. This act shall become effective
9 immediately following its passage and approval by the
10 Governor, or its otherwise becoming law.
