6 AN ACT

8 Relating to agricultural liming material; to amend
9 Sections 2-23-2 and 2-23-4 of the Code of Alabama 1975,
10 relating to the labeling of agricultural liming material sold
11 or imported into this state; to define relative neutralizing
12 value and to require agricultured liming material to be
13 labeled with the relative neutralizing value.
14 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
15 Section 1. Sections 2-23-2 and 2-23-4 of the Code of
16 Alabama 1975, are amended to read as follows:
17 "2-23-2.
18 "The following terms, as used in this chapter and
19 rules and regulations promulgated adopted under authority of
20 this chapter, shall have the following meanings, respectively:
21 "(1) AGRICULTURAL LIMING MATERIALS. Those products
22 whose calcium and magnesium compounds are capable of
23 neutralizing soil acidity
24 "(18) (2) BOARD. The Board of Agriculture and
25 Industries of the State of Alabama.
26 "(10) (3) BRAND. The term, designation, trademark,
27 product name or the specific designation under which an

1 individual or type of agricultural liming material as defined
2 in this section is offered for sale.
3 "(15) (4) BULK. Nonpackaged form.
4 "(5) BURNT LIME. A material made from limestone
5 which consists essentially of calcium oxide or a combination
6 of calcium and magnesium oxides.
7 "(3) (6) CALCITIC LIMESTONE. A calcareous rock
8 composed wholly or largely of calcium carbonate.
9 "(12) (7) CALCIUM CARBONATE EQUIVALENT or CCE. The
10 acid neutralizing capacity of an agricultural liming material
11 expressed as weight percentage of calcium carbonate.
12 "(7) (8) CHALK. A soft, friable, loosely
13 consolidated material composed largely of calcium carbonate.
14 "(17) (9) COMMISSIONER. The Commissioner of
15 Agriculture and Industries of the State of Alabama.
16 "(4) (10) DOLOMITIC LIMESTONE. A calcareous rock
17 composed of calcium and magnesium carbonates with a minimum
18 elemental magnesium (Mg) content of six percent.
19 "(11) FINENESS. The percentage by weight of the
20 material which will pass U.S. standard sieves of specified
21 sizes.
22 "(8) (12) GROUND SHELLS. A product obtained by the
23 grinding of shells of mollusks and which shall carry the name
24 of mollusk origin.
25 "(6) (13) HYDRATED LIME. A material made from burnt
26 lime which consists essentially of calcium hydroxide or a

1 combination of calcium hydroxide with magnesium oxide and/or
2 magnesium hydroxide.
3 "(9) (14) INDUSTRIAL BY-PRODUCT USED AS LIMING
4 MATERIALS. Any industrial by-product containing calcium or
5 calcium and magnesium in forms that will neutralize acidity.
6 "(16) (15) LABEL. Any written or printed matter on
7 or attached to the package or delivery ticket which
8 accompanies a bulk shipment.
9 "(2) (16) LIMESTONE. A calcareous rock composed
10 primarily of calcium carbonate or a combination of calcium and
11 magnesium carbonates.
12 "(14) (17) PERCENT or PERCENTAGE. By weight.
13 "(19) (18) PERSON. Any individual, partnership,
14 corporation, association or other legal entity, or
15 organization.
16 "(19) RELATIVE NEUTRALIZING VALUE or RNV. A
17 calculation that uses calcium carbonate equivalent and
18 fineness to represent the effectiveness of agricultural liming
19 materials.
20 "(13) (20) TON. Two thousand pounds avoirdupois.
21 "2-23-4.
22 "(a) Agricultural liming materials sold or offered
23 for sale in this state for use herein or sold for importation
24 into this state for use herein shall have affixed to each
25 container in a conspicuous manner on the outside thereof a
26 clearly legible printed or stamped label, tag, or statement

1 or, in the case of bulk sales, a delivery slip, setting forth
2 at least all of the following information:
3 "(1) The name and principal office of the
4 manufacturer, processor or distributor;.
5 "(2) The brand name of the material;.
6 "(3) The identification of the product as to the
7 type of agricultural liming material, as defined in
8 subdivisions (2) through (9) of Section 2-23-2;.
9 "(4) The minimum percent guaranteed by weight
10 passing through U. S. standard sieves as prescribed by
11 regulations of the board;.
12 "(5) The minimum guaranteed calcium carbonate
13 equivalent;.
14 "(6) The minimum guaranteed content of elemental
15 magnesium (Mg) if claimed;.
16 "(7) The minimum guaranteed content of available
17 potassium (K2O) and/or or phosphorus (P2O5), or both, if
18 claimed;.
19 "(8) The maximum water content; and.
20 "(9) Net weight.
21 "(10) The relative neutralizing value (RNV) as
22 determined by the following formula:
23 "RNV=CCE x [(0.5 x A+1 x B], where A is the percent
24 RNV=CCE x [ (0.5 x A) + (1 x B) ] , where A is the percent of
25 lime passing through a 10-mesh screen, but not a 60-mesh
26 screen, and B is the percent of lime passing through a 60-mesh
27 screen.

1 "(b) No information or statement shall appear on any
2 package label, delivery slip, or advertising matter which is
3 false or misleading to the purchaser as to the quality,
4 analysis, type, or composition of any agricultural liming
5 material."
6 Section 2. This act shall become effective on the
7 first day of the third month following its passage and
8 approval by the Governor, or its otherwise becoming law.
