2 ENROLLED, An Act,
3 To make supplemental appropriations from the
4 Education Trust Fund Advancement and Technology Fund for the
5 fiscal year ending September 30, 2020, to the public
6 institutions of higher education in the amount of $65,559,353,
7 and to the Department of Education, the Board of Trustees of
8 the Alabama Institute for Deaf and Blind, the Board of Youth
9 Services School Districts, the Board of Directors of the
10 Alabama School of Fine Arts, and the Board of Trustees of the
11 Alabama School of Math and Science in the amount of
12 $176,983,575; and to make a transfer from the Education Trust
13 Fund Advancement and Technology Fund to the Education Trust
14 Fund in the amount of $15,000,000 at the end of the fiscal
15 year ending September 30, 2020 as reimbursement for the
16 estimated first year debt service expenses of the Public
17 School and College Authority bond issue contemplated by Senate
18 Bill 242 of the 2020 Regular Session.
19 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
20 Section 1. In addition to all other appropriations
21 heretofore or hereafter made, there is hereby appropriated a
22 total of $65,559,353 from the Education Trust Fund Advancement
23 and Technology Fund to the public institutions of higher edu-
24 cation for the fiscal year ending September 30, 2020. This
25 appropriation shall be expended as provided in Section 29-9-4,

1 Section 2. In addition to all other appropriations

3 total of $176,983,575 from the Education Trust Fund
4 Advancement and Technology Fund to the Department of
5 Education, the Board of Trustees of the Alabama Institute for
6 Deaf and Blind, the Board of Youth Services School Districts,
7 the Board of Directors of the Alabama School of Fine Arts, and
8 the Board of Trustees of the Alabama School of Math and
9 Science for the fiscal year ending September 30, 2020. This
10 appropriation shall be expended as provided in Section 29-9-4,
11 Code of Alabama 1975.

17 (b) Notwithstanding any other laws to the contrary,
18 the funds appropriated to the Department of Education by
19 subsection (a) of this section shall not be expended without
20 prior approval of the State Superintendent of Education.

1 (c)(1) The above appropriation for teacher
2 professional development shall be allocated to the Alabama
3 Department of Education to be distributed to the Ed Farm
4 Classroom of Tomorrow. These funds will be used by Ed Farm to
5 provide technology tools and professional development services
6 to classroom teachers in an effort to improve instruction and
7 student learning gains. It is the intent of the legislature
8 that in addition to general programmatic costs, Ed Farm may
9 also expend funds for software, hardware, administrative costs
10 and professional learning services.
11 (2) The State Superintendent shall provide a report
12 of the initiative to the Chair of the House Ways and
13 Means-Education Committee and the Chair of the Senate
14 Committee on Finance and Taxation-Education no later than
15 October 1, 2021.
16 Section 4. Notwithstanding any other provision of
17 law, in addition to the allowable expenses from the Education
18 Trust Fund Advancement and Technology Fund provided in Section
19 29-9-4, Code of Alabama 1975, there is hereby transferred
20 $15,000,000 from the Education Trust Fund Advancement and
21 Technology Fund to the Education Trust Fund at the end of the
22 fiscal year ending September 30, 2020 to reimburse the
23 Education Trust Fund for the first-year cost of the Public
24 School and College Authority bond issue proposed by Senate
25 Bill 242 of the 2020 Regular Session or similar legislation

1 allocating bond proceeds to both public schools and
2 institutions of higher education in the state.
3 Section 5. All funds not expended in the current
4 fiscal year shall not revert but be carried forward for the
5 purpose appropriated.
6 Section 6. This act shall become effective
7 immediately upon its passage and approval by the Governor, or
8 upon its otherwise becoming law.
