2 ENROLLED, An Act,
3 To propose an amendment to the Constitution of
4 Alabama of 1901, relating to Fayette County; to provide for
5 the levy of an additional fire protection ad valorem tax of
6 three mills on real property to be paid to the Fayette County
7 Firefighters Association to be distributed equally among the
8 paid and volunteer fire departments in the county.
9 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
10 Section 1. The following amendment to the
11 Constitution of Alabama of 1901, is proposed and shall become
12 valid as a part of the Constitution when all requirements of
13 this act are fulfilled:
14 PROPOSED AMENDMENT
15 In Fayette County, commencing with the levy for the
16 tax year for which taxes will become due and payable on
17 October 1, 2021, there is levied a fire protection tax of
18 three mills on real property. The fire protection tax levied
19 in this amendment shall be based upon the value of real
20 property assessed by affected property owners, as shown on the
21 records of the Revenue Commissioner of Fayette County, and
22 shall be assessed and collected as are all ad valorem taxes in
23 the county. The amount collected each year from assessment of
24 the fire protection tax shall be paid to the Fayette County

1 Firefighters Association, to be distributed equally among the
2 paid and volunteer fire departments in the county.
3 Section 2. An election upon the proposed amendment
4 shall be held in accordance with Section 284 and Section
5 284.01 of the Constitution of Alabama of 1901, now appearing
6 as Section 284 and Section 284.01 of the Official
7 Recompilation of the Constitution of Alabama of 1901, as
8 amended, and the election laws of this state.
9 Section 3. The appropriate election official shall
10 assign a ballot number for the proposed constitutional
11 amendment on the election ballot and shall set forth the
12 following description of the substance or subject matter of
13 the proposed constitutional amendment:
14 "Relating to Fayette County, proposing an amendment
15 to the Constitution of Alabama of 1901, to provide for the
16 levy of an additional fire protection ad valorem tax of three
17 mills on real property to be paid to the Fayette County
18 Firefighters Association to be distributed equally among the
19 paid and volunteer fire departments in the county.
