A BILL
FOR AN ACT ENTITLED
1 "An Act relating to abandoned vehicles."
2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
3 * Section 1. AS 28.11.010(d) is amended to read:
4 (d) Except as otherwise provided in (b) of this section, the lawful owner of a
5 vehicle, as shown by the records of the department, whether or not the owner has
6 complied with the provisions of AS 28.10.271, is considered responsible for the
7 abandonment of the vehicle and is liable for the cost of removal and disposition of the
8 abandoned vehicle [UNLESS
9 (1) THE VEHICLE WAS ABANDONED BY A PERSON DRIVING
10 THE VEHICLE WITHOUT THE PERMISSION OF THE OWNER; OR
11 (2) THE IDENTITY OF THE PERSON ABANDONING THE
12 VEHICLE IS ESTABLISHED AND THE ABANDONMENT WAS WITHOUT THE
13 CONSENT OF THE OWNER].
14 * Sec. 2. AS 28.11.030(a) is amended to read:
15 (a) A peace officer or an employee authorized by the state or a municipality

1 (1) shall [MAY] remove or have removed to a place for storage a
2 vehicle abandoned on a highway or [, ON] a vehicular way or area within seven days
3 after the date the vehicle is abandoned under AS 28.11.020(a); [,] or
4 (2) may remove or have removed to a place for storage a vehicle
5 abandoned on private property.
6 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to
7 read:
8 APPLICABILITY. AS 28.11.010(d), as amended by sec. 1 of this Act, and
9 AS 28.11.030(a), as amended by sec. 2 of this Act, apply to vehicles abandoned on or after
10 the effective date of this Act.
