A BILL
FOR AN ACT ENTITLED
1 "An Act relating to the definition of 'village' in the Village Safe Water Act."
2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
3 * Section 1. AS 46.07.080(2) is amended to read:
4 (2) "village" means
5 (A) a second class city;
6 (B) a first class city with a population of less than 1,000;
7 (C) a home rule municipality with a population of less than
8 1,000;
9 (D) the Annette Island Reserve established by 25 U.S.C. 495
10 for the Metlakatla Indian Community;
11 (E) a community or a census-designated place with a
12 population between 25 and 1,500 [1,000] that is represented by
13 (i) a council organized under 25 U.S.C. 476 (sec. 16 of
14 the Indian Reorganization Act);
15 (ii) a traditional village council recognized by the

1 United States as eligible for federal aid to Indians; or
2 (iii) an incorporated nonprofit entity or Native village
3 council that the Department of Commerce, Community, and Economic
4 Development, with advice from the Department of Law, has
5 determined is eligible to receive and spend a community assistance
6 payment under AS 29.60.865, if the incorporated nonprofit entity or
7 Native village council agrees to act as a village governing body for the
8 purposes of this chapter and provides for the ongoing maintenance of a
9 project funded under this chapter.
10 * Sec. 2. AS 46.07.080 is amended by adding a new paragraph to read:
11 (3) "census-designated place" means a statistical geographic area that
12 represents a closely settled, unincorporated community that is locally recognized and
13 identified by name.
