FISCAL NOTE ANALYSIS
STATE OF ALASKA BILL NO. HB61
2023 LEGISLATIVE SESSION
Analysis
This bill prohibits a state or municipal agency from placing certain restrictions on firearms and firearm accessories during a
disaster emergency declared under AS 26.23.020. For example, a state or municipal agency may not forbid the possession,
use or transfer of a personal use firearm or firearm accessory or order the confiscation of a firearm or firearm accessory
for personal use. A state or municipal agency also cannot limit the quantity or place other restrictions on the sale or
service of firearms. The closing or limiting of operating hours of an entity engaged in the sale or service of firearms or a
shooting range is also prohibited under the bill unless those restrictions apply equally to all forms of commerce in the
jurisdiction. Further, a state or municipal agency cannot suspend or revoke a permit to carry a concealed handgun unless
such action is already permitted under state law.
None of the above applies to those who are otherwise prohibited from possessing a firearm or other weapon under any
other state law. Those prohibitions will still apply.
If a state or municipal agency imposes any of the above restrictions in violation of the language of the bill a person may
bring a civil action.
Because this legislation anticipates a private cause of action against the state, the department anticipate costs would be
absorbed by existing resources. Consequently, the department does not anticipate a fiscal impact should this bill become
law.
