A BILL
FOR AN ACT ENTITLED
1 "An Act relating to insurance discrimination."
2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
3 * Section 1. AS 21.36 is amended by adding a new section to read:
4 Sec. 21.36.520. Discrimination based on political affiliation or expression
5 or elected state official status. (a) A person transacting insurance in this state may
6 not, solely because of a person's political affiliation or expression or a person's status
7 as an elected state official as defined in AS 44.99.205,
8 (1) refuse to issue or renew insurance coverage;
9 (2) limit the scope of insurance coverage;
10 (3) cancel an existing policy of insurance;
11 (4) deny a covered claim; or
12 (5) increase the premium, policy fees, or rates charged on an insurance
13 policy.
14 (b) The provisions of (a) of this section do not apply if the refusal, limitation,
15 cancellation, denial, or increase is

1 (1) based on sound underwriting or actuarial principles reasonably
2 related to actual or anticipated loss experience; or
3 (2) required or authorized by law or regulation.
4 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to
5 read:
6 APPLICABILITY. This Act applies to an insurance policy or contract issued,
7 delivered, or renewed on or after the effective date of this Act.
