A BILL
FOR AN ACT ENTITLED
1 "An Act allowing school districts to authorize one or more permanent employees to
2 possess a concealed handgun on school grounds under certain conditions; relating to the
3 duties of the Department of Public Safety; and relating to continuing education in
4 firearms training for permanent employees authorized to possess a concealed handgun
5 on school grounds."
6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
7 * Section 1. AS 11.61.210(c) is amended to read:
8 (c) The provisions of (a)(7) of this section do not apply to a
9 (1) peace officer acting within the scope and authority of the officer's
10 employment; or
11 (2) school employee authorized under AS 14.03.170 to possess a
12 concealed handgun on school grounds.
13 * Sec. 2. AS 14.03 is amended by adding a new section to article 1 to read:

1 Sec. 14.03.170. Authorization of concealed handguns on school grounds.
2 (a) The governing body of a school district may authorize one or more permanent
3 employees of a school to carry a concealed handgun on the person on school grounds
4 for defensive use if
5 (1) the governing body
6 (A) adopts a written policy specifying the manner in which a
7 concealed handgun shall be possessed and the circumstances under which a
8 concealed handgun may be used; and
9 (B) establishes physical and mental standards for an
10 authorization under this section; the standards may not be less stringent than
11 the physical and mental standards the Alaska Police Standards Council has
12 established for the employment of police officers under AS 18.65.240(a)(2);
13 and
14 (2) each permanent employee of the school authorized under this
15 section has
16 (A) met the requirements for obtaining a permit to carry a
17 concealed handgun under AS 18.65.700 - 18.65.790, including successful
18 completion of a handgun course as provided in AS 18.65.715;
19 (B) obtained a permit to carry a concealed handgun under
20 AS 18.65.700 - 18.65.790;
21 (C) completed 40 hours of a training course that is equivalent
22 to a nationally recognized training course for school resource officers; and
23 (D) met the physical and mental standards established by the
24 governing body under (1)(B) of this subsection.
25 (b) The governing body of a school district may revoke, suspend, or refuse to
26 renew a permanent employee's authorization under (a) of this section if the permanent
27 employee fails to satisfy the continuing education requirements established by the
28 Department of Public Safety under AS 18.65.820.
29 (c) In this section,
30 (1) "permanent employee" means a teacher, administrator, or other
31 person under a continuing or renewable employment contract for a period of not less

1 than one school year but does not include a person who is in probationary or
2 temporary status;
3 (2) "school grounds" has the meaning given in AS 11.71.900.
4 * Sec. 3. AS 18.65 is amended by adding a new section to article 11 to read:
5 Sec. 18.65.820. Continuing education in firearms training for school
6 personnel. The Department of Public Safety shall by regulation establish standards
7 and requirements for, and procedures for documentation of, continuing education in
8 firearms training for a permanent employee authorized to carry a concealed handgun
9 under AS 14.03.170(a). The regulations must, at a minimum, require the permanent
10 employee to complete 88 hours of continuing education in a nationally recognized
11 firearms training course each calendar year as follows:
12 (1) two hours each month;
13 (2) 12 hours each calendar quarter; and
14 (3) 16 hours each calendar year.
