A BILL
FOR AN ACT ENTITLED
1 "An Act relating to in-person voter identification."
2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
3 * Section 1. AS 15.15.225(a) is repealed and reenacted to read:
4 (a) Before being allowed to vote, each voter shall exhibit to an election official
5 one form of personal identification that contains a photograph; under this subsection,
6 permitted forms of photographic identification include a valid
7 (1) Alaska driver's license;
8 (2) identification card issued by a branch, department, agency, or
9 entity of the state, any other state, or the United States government;
10 (3) United States passport;
11 (4) employee identification card issued by any branch, department,
12 agency, or entity of the United States government, the state, or a municipality of the
13 state;
14 (5) United States military identification card;
15 (6) student identification card issued by a high school located in the

1 state or a qualified postsecondary institution, as that term is described under
2 AS 14.43.830(a); or
3 (7) tribal identification card.
4 * Sec. 2. AS 15.15.225(b) is amended to read:
5 (b) An election official may waive the identification requirements of (a) of
6 this section [REQUIREMENT] if the election official knows the identity of the voter.
7 The identification requirement may not be waived under this subsection for voters
8 who are first-time voters who initially registered by mail or by facsimile or other
9 electronic transmission approved by the director under AS 15.07.050, and did not
10 provide identification as required in AS 15.07.060.
11 * Sec. 3. AS 15.15.225 is amended by adding a new subsection to read:
12 (d) An election official shall waive the identification requirements in (a) of
13 this section if a voter provides the voter's fingerprint on the precinct register.
14 * Sec. 4. AS 15.20.203(b) is amended to read:
15 (b) An absentee ballot may not be counted if
16 (1) the voter has failed to properly execute the certificate;
17 (2) an official or the witnesses authorized by law to attest the voter's
18 certificate fail to execute the certificate, except that an absentee ballot cast in person
19 and accepted by an absentee voting official or election supervisor may be counted
20 despite failure of the absentee voting official or election supervisor to properly sign
21 and date the voter's certificate as attesting official as required under AS 15.20.061(c);
22 (3) the ballot is not attested on or before the date of the election;
23 (4) the ballot, if postmarked, is not postmarked on or before the date of
24 the election;
25 (5) after the day of election, the ballot was delivered by a means other
26 than mail; or
27 (6) the voter voted
28 (A) in person and is a
29 (i) first-time voter who initially registered by mail or by
30 facsimile or other electronic transmission approved by the director
31 under AS 15.07.050, has not provided the identification required by

1 AS 15.15.225(a), was not eligible for waiver of the identification
2 requirement under AS 15.15.225(b), and has not provided the
3 identifiers required in AS 15.07.060(a)(2) and (3) that can be verified
4 through state agency records described in AS 15.07.055(e) or a
5 fingerprint on the precinct register; or
6 (ii) voter other than one described in (i) of this
7 subparagraph, did not provide identification described in
8 AS 15.15.225(a), was not personally known by the election official,
9 and has not provided the identifiers required in AS 15.07.060(a)(2) and
10 (3) or a fingerprint on the precinct register; or
11 (B) by mail or electronic transmission, is a first-time voter who
12 initially registered by mail or by facsimile or other electronic transmission
13 approved by the director under AS 15.07.050 to vote, has not met the
14 identification requirements set out in AS 15.07.060, and does not submit with
15 the ballot a copy of a
16 (i) driver's license, state identification card, current and
17 valid photo identification, birth certificate, passport, or hunting or
18 fishing license; or
19 (ii) current utility bill, bank statement, paycheck,
20 government check, or other government document; an item described
21 in this sub-subparagraph must show the name and current address of
22 the voter.
23 * Sec. 5. AS 15.20.207(b) is amended to read:
24 (b) A questioned ballot may not be counted if the voter
25 (1) has failed to properly execute the certificate;
26 (2) is a first-time voter who initially registered by mail or by facsimile
27 or other electronic transmission approved by the director under AS 15.07.050, has not
28 provided the identification required by AS 15.15.225(a), was not eligible for waiver of
29 the identification requirement under AS 15.15.225(b), and has not provided the
30 identifiers required in AS 15.07.060(a)(2) and (3) that can be verified through state
31 agency records described in AS 15.07.055(e) or a fingerprint on the precinct

1 register; or
2 (3) is a voter other than one described in (2) of this subsection, did not
3 provide identification described in AS 15.15.225(a), was not personally known by the
4 election official, and has not provided the identifiers required in AS 15.07.060(a)(2)
5 and (3) or a fingerprint on the precinct register.
