A BILL
FOR AN ACT ENTITLED
1 "An Act relating to the awarding of public construction contracts; and relating to the
2 materials and services used by contractors for public construction contracts."
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
4 * Section 1. AS 36.05.035 is amended to read:
5 Sec. 36.05.035. Notification of contract awards. Upon awarding a public
6 construction contract, the state or a political subdivision of the state shall
7 (1) immediately notify the commissioner of labor and workforce
8 development of the amount of the contract, the effective date of the contract, the
9 identity of the contractor and all subcontractors, and the site or sites of construction;
10 (2) within 5 days, [AND] provide a project description; and
11 (3) [(2)] verify that the bonding requirements of AS 36.25 have been
12 met and that the requirements of AS 08.18 have been met.
13 * Sec. 2. AS 36.15 is amended by adding a new section to read:
14 Article 3. Use of Materials and Services from the State or the United States.

1 Sec. 36.15.100. Materials and services used in public construction
2 contracts. In addition to other requirements for a contract under this title, a person
3 who contracts with the state or a political subdivision of the state to perform a public
4 construction project shall use, whenever possible, for the performance of the contract,
5 materials and services that are manufactured or provided
6 (1) by a manufacturer or business in the state; or
7 (2) for a material or service that is not available under (1) of this
8 section, by a manufacturer or business in the United States.
9 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to
10 read:
11 TRANSITION. This Act applies to contracts that are entered into on or after the
12 effective date of this Act.
