FISCAL NOTE ANALYSIS
STATE OF ALASKA BILL NO. SB 120
2021 LEGISLATIVE SESSION
Analysis
SB 120 proposes re-establishing in statute a permanent interim committee to review proposed regulations that would
implement newly enacted legislation. The committee would also review proposed regulations at the written request of a
standing committee, the Administrative Regulation Review Committee, or the Legislative Council.
This work would be conducted by the Legislative Affairs Agency Legal and Research Services Division (LAA), within
available staff resources and priorities set by Legislative Council. This legislation directs LAA to assign one or more
attorneys to conduct reviews of the proposed regulations. Legal Services is at capacity with its current workload and could
not accomplish this work without additional staff.
When LAA previously took on this regulation review role, approximately 200 packets of proposed regulations were
received for review each legislature. On average, one-third of those packets raised legal issues, requiring a memo
explaining the legal issues. Therefore, based on prior experience, we have included funding for one full-time attorney to
perform this work at a range 24 (reflected on the Personal Services line of this fiscal note).
It is the sponsors intent for existing staff to handle the workload of this committee. As such, there is no funding for
committee staff included in this fiscal note.
The legislation states that members are entitled to travel and per diem allowances when attending meetings. It is the
sponsors intent that there will be six meetings annually. For this fiscal note, we assume three meetings would be held
during session with three interim meetings held in Anchorage to estimate travel costs. It is assumed public hearings will be
held telephonically.
The anticipated travel expense for six members is $15,300, based on an average trip cost of $850 (6 members = $5,100 x 3
= $15,300).
Teleconference and supply costs will be absorbed within existing budgets.
