A BILL
FOR AN ACT ENTITLED
1 "An Act providing immunity from liability for exposure of a natural person to
2 COVID-19; and providing for an effective date."
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
4 * Section 1. The uncodified law of the State of Alaska is amended by adding a new section
5 to read:
6 LIABILITY FOR EXPOSURE TO COVID-19. (a) Notwithstanding another provision
7 of law to the contrary and subject to (b) of this section and AS 23.30, a natural person, a
8 corporation, a nonprofit corporation, a partnership, a limited liability company, an association,
9 a joint venture, a trust, an estate, a municipal school district, a regional educational attendance
10 area, a church or religious organization, a municipality, a college, university, or other
11 institution of higher education, the Alaska Railroad, a public corporation or authority, and the
12 executive, legislative, and judicial branches of state government are immune from civil
13 liability for sickness, death, economic loss, and other damages resulting from exposure of a
14 natural person to COVID-19.

1 (b) The immunity provided under (a) of this section does not apply to exposure to
2 COVID-19 resulting from gross negligence, recklessness, or intentional misconduct.
3 (c) The immunity provided under (a) of this section is in addition to any other
4 immunity from liability provided under state or federal law.
5 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to
6 read:
7 APPLICABILITY. (a) Section 1 of this Act applies to COVID-19 exposure occurring
8 on or after the effective date of sec. 1 of this Act.
9 (b) Nothing in this Act modifies the application of AS 23.30.
10 * Sec. 3. This Act is repealed August 31, 2025.
11 * Sec. 4. This Act takes effect immediately under AS 01.10.070(c).
