Analysis
This bill amends AS 08 relating to business and professions by adding a new chapter 08.69 to enact and enter into the
Multistate Nurse Licensure Compact. The bill establishes the framework for the Alaska Board of Nursing to join the
compact which would allow registered nurses and licensed practical nurses from other states to work in Alaska under
their current state licensure in lieu of the current requirement to gain licensure in Alaska. Through this bill Alaska would
adopt the licensure requirements under the compact which exceed those in present statute, including the requirement
for a national criminal history record background check.
Under the authority of AS 12.62.160 and AS 12.62.400, the Department of Public Safety (DPS) receives and processes
requests for state and national criminal history record checks for noncriminal justice licensing or employment purposes,
including licensure to practice nursing. From fiscal years 2017 through 2020, DPS conducted an average of 3,117 per year
criminal history record checks on prospective nurses.
Should this bill pass, licensed nurses from other states would not need to submit to a new criminal history record
background check to gain licensure in Alaska, thereby reducing the number of requests submitted to DPS. Fewer criminal
history background check submissions would reduce workflow in line with the reduction in revenue from the fees DPS
receives for these requests. The fiscal impact of this legislation cannot be determined because it is unknown how many
fewer record check requests DPS will receive and therefore cannot estimate the reduction in associated revenue. It is not
anticipated that the impact will be substantial however, and a therefore zero fiscal note is being submitted.
