A BILL
FOR AN ACT ENTITLED
1 "An Act relating to restrictions placed on users of interactive computer services based
2 on content or viewpoint; and adding unlawful acts to the Alaska Unfair Trade Practices
3 and Consumer Protection Act."
4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
5 * Section 1. AS 45.45 is amended by adding a new section to read:
6 Sec. 45.45.940. Interactive computer service restrictions based on content
7 or viewpoint. (a) A person that is an interactive computer service that represents itself
8 as having neutral, impartial, or nonbiased content may not, based on the content or
9 viewpoint expressed by a user of the service,
10 (1) block the user's content;
11 (2) censor the user's content;
12 (3) ban the user from using the service;
13 (4) remove the user's content;
14 (5) block or partially block the user or the user's content in a way that

1 is not readily apparent to the user;
2 (6) remove the user from a social media platform;
3 (7) require a viewer to take more steps to view the user's content than
4 are required to view the content of other users;
5 (8) remove the ability of the user's content to earn advertising income;
6 or
7 (9) otherwise restrict the speech or content of the user on the service.
8 (b) A person that is an interactive computer service does not violate (a) of this
9 section if the interactive computer service
10 (1) voluntarily and in good faith restricts access to or availability of
11 content that the interactive computer service reasonably considers to be obscene, lewd,
12 lascivious, filthy, excessively violent, harassing, or otherwise objectionable, regardless
13 of whether the content is protected by the Constitution of the State of Alaska or the
14 Constitution of the United States; or
15 (2) acts to enable, or make available to a person, the technical means to
16 restrict access to content described in (1) of this subsection.
17 (c) The prohibition in (a) of this section does not apply to a person that only
18 provides a connection to the Internet or another wide area network.
19 (d) In this section,
20 (1) "interactive computer service" means a service, system, access
21 software provider, Internet website, Internet application, Internet portal, or social
22 media platform that furnishes or enables computer access by multiple users to an
23 Internet server;
24 (2) "social media platform" means an Internet platform for users to
25 share content with other persons;
26 (3) "user" means a person that posts, uploads, transmits, or otherwise
27 publishes content through an interactive computer service.
28 * Sec. 2. AS 45.50.471(b) is amended by adding a new paragraph to read:
29 (58) violating AS 45.45.940 (interactive computer service restrictions
30 based on content or viewpoint).
