STATE OF ALASKA BILL NO. SB 43
2021 LEGISLATIVE SESSION
Analysis
This legislation amends the crime of unlawful interference with voting in the second degree to include
1) Knowingly assisting a voter in marking an absentee ballot and failing to print the voters name and the persons name
and physical address on the voters certificate on the envelope; or signing and dating the voters certificate;
2) Knowingly assisting a voter in marking an absentee ballot and being a candidate, ballot measure campaign employee,
volunteer, sponsor, or circulator; and
3) Knowingly possessing a ballot for statewide election that has been mailed to another person unless the person
possessing the ballot is an election official engaged in official duties, an employee of the United States Postal Office
or another person authorized by law to collect mail, or a family member, household member, or caregiver of the voter
to whom the ballot was mailed.
Unlawful interference in the second degree is a class A misdemeanor punishable by up to one year in jail.
While this legislation may result in an increase in cases, the Department of Law does not expect that increase to be
significant enough to require additional funding. Therefore, the department does not anticipate a fiscal impact from this
legislation.
