A BILL
FOR AN ACT ENTITLED
1 "An Act relating to justification of use of force by a peace officer; and relating to
2 shooting at a moving vehicle."
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
4 * Section 1. AS 11.81.370 is amended by adding a new subsection to read:
5 (d) If, in making an arrest or stop, a peace officer knowingly discharges a
6 firearm at or in the direction of a propelled vehicle while another person is operating
7 the vehicle, the use of force is not justified under this section unless the person is
8 operating the vehicle in a manner that poses an immediate threat of serious risk to the
9 life of the officer or another person.
10 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to
11 read:
12 APPLICABILITY. AS 11.81.370(d), enacted by sec. 1 of this Act, applies to conduct
13 by a peace officer occurring on or after the effective date of this Act.
