FISCAL NOTE ANALYSIS
STATE OF ALASKA BILL NO. HB 45
2021 LEGISLATIVE SESSION
Analysis
This legislation would establish a workers compensation presumption for certain emergency responders, front line
workers, and healthcare providers when Alaska is under a disaster declaration due to an outbreak of a contagious disease,
as declared by the Governor. This would limit an employer's ability to contest a claim under the limited circumstances of
the disaster declaration and would ensure that front line employees receive workers compensation insurance coverage
for medical costs and lost wages as a result of contracting the illness in the workplace.
This legislation would be applicable to approximately onethird of the current workforce in Alaska, and would take effect
retroactively to November 15, 2020 for some job categories defined as first responders and immediately for child care,
teachers, and grocery store employees.
The division anticipates no fiscal impact from this legislation.
