FISCAL NOTE ANALYSIS
STATE OF ALASKA BILL NO. 0
2020 LEGISLATIVE SESSION
Analysis
Proposed changes in this legislation will not result in fiscal or programmatic impact on the Department of Health and
Social Services (DHSS), Alaska Psychiatric Institute (API).
The bill makes the following changes:
1) Clarifies when a person can be held in correctional facilities pending transportation to an evaluation facility, and that
this hold cannot be recorded as an arrest.
2) Changes the hearing scheduling component so that the hearing must be set within 96 hours and the full 72 hours is
given to the facility for evaluation.
3) Clarifies that a person who has been detained, but not yet transported to an evaluation facility, is not in the custody of
the DHSS. Custody will begin when DHSS takes custody for travel to evaluation facilities.
