A BILL
FOR AN ACT ENTITLED
1 "An Act relating to permits for trapping cabins."
2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
3 * Section 1. AS 38.95.080 is repealed and reenacted to read:
4 Sec. 38.95.080. Trapping cabin permit. (a) The commissioner may issue a
5 nonexclusive, nontransferable permit for a trapping cabin on state land to a person
6 who meets the following qualifications:
7 (1) the person must be at least 18 years of age;
8 (2) the person must possess a trapping license issued under
9 AS 16.05.330 - 16.05.430;
10 (3) the person must provide proof accepted by the director of an
11 established trapline of sufficient length to justify the need for cabin construction or use
12 and demonstrate substantial trapping activity.
13 (b) A permit issued to a person under this section may be for
14 (1) the construction of a new trapping cabin; or
15 (2) the use of a preexisting cabin if

1 (A) the person owns the preexisting cabin;
2 (B) the owner of the preexisting cabin approves the person's
3 use of the cabin; or
4 (C) there is no owner of the preexisting cabin.
5 (c) The commissioner, upon recommendation of the director, shall establish a
6 reasonable rate or fee, not to exceed $500, to be charged for permits issued under this
7 section.
8 (d) The director may issue multiple permits for the use of a single trapping
9 cabin.
10 (e) The director shall establish by regulation conditions, limitations, and terms
11 of a permit issued under this section. The conditions must include the following:
12 (1) the duration of a permit may not exceed five years;
13 (2) a single permit may authorize the use of up to three cabins;
14 (3) a person shall construct and maintain a cabin or, if the cabin is
15 preexisting, shall maintain the cabin according to specifications established by the
16 director;
17 (4) a person may not enlarge a preexisting cabin beyond the
18 specifications established by the director.
19 (f) A permit issued under this section is not a disposal of interest and does not
20 convey an interest in land, does not grant or establish a preferred right to a lease or
21 purchase of land, and does not, except as authorized by the commissioner, allow for
22 other uses of a cabin or land adjacent to a cabin for any purpose other than trapping.
23 (g) A person who violates this section or a term or condition of a permit issued
24 under this section may have the permit immediately revoked and is subject to payment
25 of all costs incurred in dismantling and disposing of a cabin structure and reclamation
26 of land as required by the director.
27 * Sec. 2. AS 38.95.085 is amended to read:
28 Sec. 38.95.085. Definitions for AS 38.95.080 and 38.95.085 [AS 38.95.075 -
29 38.95.085]. In AS 38.95.080 and 38.95.085 [AS 38.95.075 - 38.95.085],
30 (1) "commissioner" means the commissioner of natural resources;
31 (2) "director" means the director of the division of lands established
