A BILL
FOR AN ACT ENTITLED
1 "An Act requiring certain school districts to give teachers who are nursing mothers
2 reasonable breaks and a location to express breast milk."
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
4 * Section 1. AS 14.20 is amended by adding a new section to read:
5 Sec. 14.20.098. Reasonable break time and location for nursing mothers.
6 (a) Subject to (b) of this section, a school district shall, for a period of one year
7 beginning on the date of the birth of her nursing child, provide a teacher who is a
8 nursing mother
9 (1) reasonable break periods to express breast milk; and
10 (2) a private and sanitary place in the workplace, other than a
11 bathroom, to express breast milk.
12 (b) Except as may be required otherwise by a contract, a school district may
13 not be required to
14 (1) pay a teacher for a break under (a) of this section;

1 (2) comply with (a) of this section, if
2 (A) the school district employs fewer than 50 persons; and
3 (B) the difficulty and expense of meeting the requirements
4 under (a) of this section, when considered in relation to the school district's
5 financial resources, are significant and would cause the school district undue
6 financial hardship.
7 (c) Nothing in this section prohibits a school district from providing a teacher
8 who is a nursing mother with rights in addition to those provided under (a) of this
9 section.
