FISCAL NOTE ANALYSIS

2020 LEGISLATIVE SESSION
Analysis
This bill amends AS 12.55.155(c) relating to factors in aggravation and mitigation by adding a new paragraph (38) to the
list of aggravating factors. The new aggravator to be considered at sentencing would apply to defendants convicted under
AS 11.56.375 (promoting contraband in the first degree) if, at the time of the offense, the defendant was a volunteer,
contractor, or employee of the Department of Corrections and the offense was committed during the defendants duties
as a volunteer, contractor, or employee.
The Department of Public Safety, Division of Alaska State Troopers (AST), Alaska Bureau of Investigation (ABI) is
responsible to respond to and investigate crimes occurring inside state correctional facilities. This bill impacts sentencing
provisions for existing crimes and is therefore not expected to impact response or investigation by AST. Consequently, a
zero fiscal note is being submitted.
