Analysis
This legislation amends AS 12.55.155 (c) adding a new subsection that provides for an aggravating factor at sentencing for
contractors, volunteers, and employees of the Department of Corrections (DOC) who are convicted under AS 11.56.375
and the act was committed in the course of their employment, services or volunteer duties. AS 11.56.375 Promoting
Contraband in the First Degree is a class C felony that typically carries a sentence of 0 2 years with a maximum sentence
of 5 years for aggravated offenses. AS 12.55.155(c) (Factors in Aggravation) allow for a sentence to be imposed outside of
the presumptive range (0 to 2 years). By adding an additional aggravator under AS 12.55.155(c), this would allow a court
to impose a lengthier sentence on employees, contractors and volunteers who are held in a position of trust.
This legislation will send a strong public safety message of zero tolerance for introduction of contraband into any DOC
facility. While there is no current data to determine the full impact to the prison population, it is anticipated that any
impacts from this legislation will be minimal. The Department will monitor financial impacts if this legislation is passed.
