Analysis
Under current law, negotiated timber sales are allowed under three different statutes. This bill creates one
comprehensive negotiated timber sales statute to provide the commissioner of the Department of Natural Resources with
the flexibility to negotiate timber sales that balance the evolving economics of the timber industry with the Alaska
Constitutions mandate for resource development in the public interest.
The bill also amends statutes on forest land use plans (FLUPs) to exempt forest land use plans from being subject to
appeal or reconsideration under AS 44.37.011 and 11 AAC 02, while keeping timber sale contracts authorized by a
director's best interest finding (BIF) subject to appeal under 44.37.011.
The bill requires no changes in department staff or budgets, as the work covered is part of the Division of Forestry's
normal duties. The bill will not result in any changes to departmental revenue, as the authorities it modifies all currently
exist.
The bill will require changes to the sections of 11 AAC 71 addressing negotiated sales under each of the modified or
deleted negotiated sale authorities (AS 38.05.115, AS 38.05.118 and AS 38.05.123).
