A BILL
FOR AN ACT ENTITLED
1 "An Act exempting veterinarians from the requirements of the controlled substance
2 prescription database."
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
4 * Section 1. AS 17.30.200(o) is amended to read:
5 (o) The board shall promptly notify the State Medical Board, the Board of
6 Nursing, the Board of Dental Examiners, and the Board of Examiners in Optometry [,
7 AND THE BOARD OF VETERINARY EXAMINERS] when a practitioner registers
8 with the database under (n) [(o)] of this section.
9 * Sec. 2. AS 17.30.200(s) is amended by adding a new paragraph to read:
10 (6) "practitioner"
11 (A) means a physician, dentist, advanced practice registered
12 nurse, optometrist, scientific investigator, or other person licensed, registered,
13 or otherwise permitted to distribute, dispense, conduct research with respect to,
14 or to administer or use in teaching or chemical analysis a controlled substance

1 in the course of professional practice or research in the state;
2 (B) means a pharmacy, hospital, or other institution licensed,
3 registered, or otherwise permitted to distribute, dispense, conduct research with
4 respect to, or to administer a controlled substance in the course of professional
5 practice or research in the state;
6 (C) does not include a veterinarian.
7 * Sec. 3. AS 17.30.200(u) is amended to read:
8 (u) A practitioner or a pharmacist is not required to comply with the
9 requirements of (a) and (b) of this section if
10 (1) the practitioner is a veterinarian licensed under AS 08.98; or
11 (2) a controlled substance is
12 (A) [(1)] administered to a patient at
13 (i) [(A)] a health care facility; or
14 (ii) [(B)] a correctional facility; or
15 (B) [(2)] dispensed to a patient for an outpatient supply of 24
16 hours or less at a hospital
17 (i) [(A)] inpatient pharmacy; or
18 (ii) [(B)] emergency department.
19 * Sec. 4. AS 08.98.050(a)(10) is repealed.
