A BILL
FOR AN ACT ENTITLED
1 "An Act relating to the identification, location, and notification of specified family
2 members of a child who is in state custody."
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
4 * Section 1. AS 47.10 is amended by adding a new section to read:
5 Sec. 47.10.035. Notice to noncustodial parent or adult family member; due
6 diligence. (a) Within 30 days after removal of a child from the child's home and
7 placement of the child in out-of-home care under this chapter, the department shall
8 exercise due diligence to identify, locate, and notify of the removal noncustodial
9 parents and adult family members of the child. If circumstances prevent the
10 department from completing this due diligence search in 30 days, the department shall
11 complete the search as soon as possible.
12 (b) A supervisor of the division of the department with jurisdiction over
13 children in need of aid shall verify in writing, in a timely manner, the due diligence of
14 the department exercised under (a) of this section.

1 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to
2 read:
3 APPLICABILITY. Section 1 of this Act applies to a child in the custody or under the
4 supervision of the Department of Health and Social Services under AS 47.10 on or after the
5 effective date of sec. 1 of this Act.
6 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to
7 read:
8 TRANSITION: REGULATIONS. The Department of Health and Social Services may
9 adopt regulations necessary to implement the changes made by this Act. The regulations take
10 effect under AS 44.62 (Administrative Procedure Act), but not before the effective date of the
11 law implemented by the regulation.
