STATE OF ALASKA BILL NO. HB187
2020 LEGISLATIVE SESSION
Analysis
This legislation changes the current authority of the Commissioner of Corrections when designating the placement of
prisoners who are under the departments custody.
AS 33.30.031 (a) is amended to allow the placement of prisoners into an out of state facility only if it locates the prisoner
closer to family or due to the prisoners health issues.
This legislation eliminates the departments ability to place prisoners in other states under the Interstate Corrections
Compact (ICC) agreement or through the competitive procurement contract process. The department currently places
prisoners in other state or federal facilities, public or private, for security reasons such as when former law enforcement
officers, high security or separatee prisoners are placed under the departments custody. If this legislation were passed,
these prisoners would be required to remain within an Alaska prison and could jeopardize the safety and security of the
staff, prisoners, and facility.
Additionally, as the prisoner population continues to grow, the department will not have the ability to absorb the
increases without this flexibility. The offender population projections show a continued increase to the prison population
and it is expected that current capacity will be exceeded by April 2020. If this legislation were passed, it is unknown the
full financial impacts that could result from; facility overcrowding, increased staffing overtime, potential litigation, facility
renovations and repairs, as well as other costs associated with identifying increased bed capacity; therefore, an
indeterminate fiscal note is being submitted.
The Department will monitor for any future financial and population impacts if this legislation is passed.
