2019 LEGISLATIVE SESSION
Analysis
This bill adds language making theft of an identification document theft in the second degree. It also adds additional
language stating that if the cumulative value of items stolen within 180 days is more than $750 but less than $25,000, the
offense is theft in the second degree. In CY2018, there were 288 theft in the second degree convictions resulting in
incarceration. This may increase the prison population, but the department does not have data that allow it to project the
change.
This bill also adds identification documents to fraudulent use of an access device. The crime may be either a class B or
class C felony or a class A misdemeanor; the crime degree depends on the value of the property or services obtained
through the fraudulent use. In CY2018, there were 14 convictions for fraudulent use of an access device that resulted in
incarceration. This may increase the prison population, but the department does not have data that allow it to project the
change.
This bill also adds a new theft section related to possession of motor vehicle theft tools. Because this is a new crime, the
department does not have data that allow it to project the inmate on the prison population.
