FISCAL NOTE ANALYSIS
STATE OF ALASKA BILL NO. SB088
2020 LEGISLATIVE SESSION
Analysis
This bill updates the operating legislation for the Office of Administrative Hearings (OAH). Only one aspect of the bill has
potential fiscal impact. The bill removes the automatic payment of a Juneau salary differential to the Chief Administrative
Law Judge. At the same time, it removes the limitation on step placement for the Chief Administrative Law Judge, so that
the chief could progress or remain beyond step F. Neither change would apply to the incumbent Chief Administrative Law
Judge.
Because the current Chief's term continues until March of 2024, no impact is anticipated in FY21, FY22, or FY23. Should a
new Chief Administrative Law Judge be appointed in 2024, a modest positive or negative fiscal impact could occur
beginning late in FY24. The salary could be higher (due to a step placement above step F), or lower (due to removal of
Juneau salary differential for an Anchorage-based chief), or may remain unchanged. OAH therefore, submits an
indeterminate fiscal note.
