Why this fiscal note differs from previous version/comments:
This version of the bill removes the permit application fees from statute, giving the department the flexibility to establish them in
regulation. Additionally, the department's previous fiscal note reflected an indeterminate cost. Since adopting the initial fiscal note, the
Commercial Fisheries Division's new leadership has determined that the additional work load will likely be minimal and can be
absorbed by existing staff. The additional workload will result in increased time required to process and issue permits and respond to
public inquiries, and a reduction in less critical industry support efforts. However, issuance of permits will be within prescribed time
frames.

Analysis
The Commercial Fisheries Division intends to utilize existing staff under the Aquaculture Section to administer the
program proposed in this legislation. The Private Nonprofit Hatchery Permit Coordinator is the primary person responsible
for evaluating these permit applications. Department of Fish and Game genetics, pathology, and management staff also
contribute to the permit application review process. Permit application review generally takes six months to one year to
complete. The department believes it can absorb the increase in work load with all existing resources.
The permit application fee for shellfish enhancement projects and new salmon private nonprofit hatcheries will be
removed from statute. This will give the department the flexibility to set fees in regulation. This additional flexibility
coupled with unknown industry interest in new projects is why the division is anticipating indeterminate revenue.
However, the division can estimate two or three applications per year for the first two years and then a decline to an
estimated one permit application per year.
