FISCAL NOTE ANALYSIS
STATE OF ALASKA BILL NO. HB 27
2020 LEGISLATIVE SESSION
Analysis
HB 27 would add new sections to AS 18.31 entitled "ToxicFree Firefighters and Children Act", regarding the use of flame
retardant chemicals in consumer products. The bill would prohibit manufacturing, selling or offering to sell, or distributing
for sale a consumer product containing specific flame retardant chemicals listed in Section 3. Section 3 of the bill would
require that manufacturers label products, stating whether the product does or does not contain any flame retardant
chemical.
If manufacturers, sellers, or distributors violate these provisions, Section 3 would provide a civil penalty. It would also
make the violation an unfair trade practice under AS 45.50.471 45.50.561, which would allow the Department of Law's
Special Litigation component to commence an investigation under AS 45.50, possibly subjecting individuals to additional
remedies.
Should HB 27 become law, the Department of Law expects a limited increase in work, but anticipates it could be absorbed
into existing resources.
