2018 LEGISLATIVE SESSION
Analysis
This legislation would allow certain fish and game offenses to be charged as violations rather than misdemeanors,
reducing penalties. The legislation allows the state to increase restitution amounts from resource users who fail to obtain
a hunting or fishing license, and potentially increase the criminal fines for certain offenses.
The Department of Administration, Division of Shared Services (SSoA), now has responsibility for nonrestitution
collections for the State of Alaska. Fines collected are deposited into the General Fund (GF) as Undesignated General
Funds (UGF). Collections are handled by a vendor, paid a percentage of successful collections, so no additional work or
additional funds are required by the Department as a result of these changes.
While not a revenue bill, there may be a change in revenue as a result of this bill, but the revenue is indeterminate. The
legislation may act as a deterrent, resulting in fewer offenses and less revenue. However, the number of offenses may not
be impacted, resulting in additional revenue from the increases in this legislation.
The Court system does not distinguish between types of criminal fines; therefore, SSoA cannot determine whether the
fines they collect were levied for violations outlined in this legislation. SSoA cannot predict the amount of fines that may
be collected in the future, nor what percentage of those fines may result from violations outlined in this legislation. The
agency submits an indeterminate fiscal note.
