2018 LEGISLATIVE SESSION
Analysis
This bill fixes gaps identified in the initial statutes (AS 47.05.310- AS 47.05.390), to centralize and formalize the process by
which the Department of Health and Social Services conducts criminal background checks for entities and individuals
seeking to be licensed or certified providers, individuals who are employed by licensed or certified providers, and
individuals who are paid, in whole or in part, by DHSS to provide for the health, safety, and welfare of individuals receiving
services from the department.
This legislation improves consistency in the application of barring conditions for all individuals in direct contact with
vulnerable individuals. Currently, the statutes provide that only certain position types be barred for certain offenses; the
same standards are not applied to all applicants. The department is finding that applicants are manipulating this loophole
in the application process, and the statutes have exposed vulnerable Alaskans to individuals intended to be barred from
contact.
The department will continue to use existing registries to meet the requirements of the various sections of this bill. There
will not be any costs associated with the implementation of this legislation; therefore a zero fiscal note is submitted.
