This bill amends the Industrial Development Information and Siting Act to exempt certain processing facilities from specific requirements. It introduces new exemptions for processing facilities constructed within the permitted area of existing coal or trona mines, as well as those located in designated industrial parks. Specifically, the bill adds new paragraphs (vi) and (vii) to subsection (c) of W.S. 35-12-119, which outline these exemptions. Additionally, a new subsection (e) is created to clarify that local governments retain the authority to negotiate and enforce agreements regarding the impacts of these industrial facilities.

The bill specifies that these changes will apply to all industrial facilities for which a jurisdiction determination is made on or after July 1, 2027. For facilities with determinations made before this date, the existing laws will continue to apply. The industrial siting council is tasked with creating the necessary rules to implement the act, which will take effect on July 1, 2027, with certain sections becoming effective immediately upon the bill's passage.
