This bill amends existing laws regarding the management and regulation of surface water runoff and diversion systems by cities and towns in Wyoming. It establishes new requirements for surface water systems that were created before April 1, 2026, mandating that they either be reclassified as part of a surface water drainage utility or operate solely on funds not collected from user fees by July 1, 2027. If these conditions are not met, cities and towns must refund all fees collected prior to April 1, 2026, to users of the system. Additionally, the bill specifies that cities and towns cannot charge fees for these systems after April 1, 2026, unless approved by voters.

The bill also includes provisions for the establishment of a board of public utilities to manage these systems and outlines the process for transitioning existing systems to comply with the new regulations. An appropriation of $5,000 is allocated from the general fund to assist cities and towns in this transition, with funds distributed on a pro-rata basis. The act is set to take effect immediately upon completion of the necessary legislative processes.
