This bill amends the zoning protest process for cities and towns in Wyoming, specifically altering the requirements for property owners to successfully protest changes in zoning regulations, restrictions, or district boundaries. The new language specifies that a protest must be signed by more than one owner who demonstrates a concrete and particularized harm and who either owns thirty-three percent (33%) or more of the area of the lots included in the proposed change or comprises thirty-three percent (33%) or more of the owners immediately adjacent within a distance of three hundred (300) feet. Additionally, the bill changes the threshold for the governing body's affirmative vote from three-fourths (3/4) to two-thirds (2/3) for the change to be effective.
The bill also clarifies that the width of any intervening street or alley will not be included when determining the three hundred (300) feet distance for adjacent property owners. This act will apply to zoning changes made on and after July 1, 2026, and will take effect on the same date.
